These Terms of Utility, also referred to as Terms of Use, apply to websites, mobile applications, APIs, portals, installed devices, SIM-based devices, tracking dashboards, reporting tools, support systems, and related services supplied or operated by White Light Services and Trading LLC for IVMS, WFM Track, vehicle monitoring, fleet telematics, GPS tracking, video telematics support, driver behavior monitoring, and compliance reporting.
By accessing or using the services, the customer, account administrator, driver, employee, contractor, or authorized user agrees to use the services only for lawful business, safety, fleet-management, OPAL-aligned IVMS, and customer-approved operational purposes in the Sultanate of Oman or other approved operating territories.
1. Services Covered
The services may include IVMS devices, GPS tracking devices, sensors, driver identification accessories, mobile applications, web dashboards, alerts, reports, geofencing, route history, driver behavior scoring, video telematics links, installation, configuration, integration, training, support, maintenance, hosting, data storage, and related professional services.
Features may vary by hardware model, subscription plan, network coverage, customer configuration, vehicle type, site requirements, OPAL or oil and gas client requirements, and third-party service availability.
2. Customer Responsibilities
Customers are responsible for ensuring that their use of the services is lawful, authorized, and consistent with Oman law, customer HSE policies, OPAL-aligned IVMS procedures, employment rules, site rules, and any applicable fleet, transport, insurance, or oil and gas contract requirements.
Customers must notify drivers, employees, contractors, and authorized users that vehicles, devices, mobile applications, and accounts may be monitored; obtain all required consents or authorizations; assign only authorized users; keep account details accurate; protect credentials; maintain vehicles and installed equipment; and promptly report suspected misuse, device tampering, theft, security incidents, or data inaccuracies.
3. Acceptable Use
Users must not misuse the services, access another customer's data, reverse engineer software or devices, bypass security controls, interfere with networks, upload unlawful content, use the services for harassment or unlawful surveillance, disable safety features without authorization, tamper with devices, falsify driver identity, overload systems, introduce malware, or use reports in a misleading way.
Customers must not use IVMS or tracking data to violate applicable labor, privacy, safety, transport, or anti-discrimination laws. Monitoring must be limited to legitimate fleet, safety, security, compliance, operational, or contractual purposes.
4. OPAL and IVMS Compliance
White Light provides technology intended to support IVMS, journey management, driver behavior monitoring, audit reporting, and fleet safety programs used by oil and gas, logistics, construction, utility, and commercial fleets in Oman. The services can help customers maintain records, alerts, and reports required by internal HSE standards, client site rules, and OPAL-aligned IVMS programs.
Unless expressly stated in a signed document, White Light does not guarantee that a customer's fleet, drivers, vehicles, routes, procedures, or operations are compliant. The customer remains responsible for operational compliance, driver training, vehicle roadworthiness, journey approval, incident response, inspection readiness, and submission of records to any client, auditor, authority, or OPAL-related program.
5. Data, Reports, and Evidence
Tracking data, alerts, driver scores, video links, logs, and reports are generated from devices, sensors, GPS signals, mobile devices, SIM networks, map providers, software rules, and customer configuration. They are business records intended to support decision-making, but they may be affected by network coverage, GPS drift, blocked signals, device faults, incorrect installation, tampering, power loss, calibration, map errors, or delayed transmission.
Customers should review critical reports, incidents, and disciplinary or safety decisions with reasonable human oversight and supporting evidence. White Light may assist with diagnostics, but the customer is responsible for final operational decisions based on the data.
6. Mobile Applications and Permissions
Mobile applications may request permissions such as location, notifications, camera, photo upload, storage, or device identifiers to support trip tracking, user authentication, evidence upload, support tickets, alerts, and fleet workflows. Users must not grant permissions or use the mobile application unless authorized by their employer, fleet owner, or account administrator.
Background location, where enabled, may continue while a trip, duty status, or monitoring workflow is active. Users should follow employer policies and local law before using personal devices for business tracking.
7. Account Security
Customers and users are responsible for protecting usernames, passwords, devices, mobile phones, SIMs, and account access. White Light may suspend access if we suspect unauthorized use, security risk, unpaid services, device abuse, regulatory risk, or breach of these terms. Account administrators are responsible for promptly removing access for employees, contractors, or users who no longer require it.
8. Third-Party Services
The services may depend on telecommunications networks, GPS satellites, cloud hosting, map data, app stores, payment providers, customer systems, vehicle power supply, OEM interfaces, and other third-party systems. White Light is not responsible for failures, delays, inaccuracies, outages, policy changes, or restrictions caused by third parties outside our reasonable control.
9. Fees, Suspension, and Changes
Fees, subscription periods, hardware charges, installation charges, support scope, SLA levels, and renewal terms are governed by the applicable quote, purchase order, invoice, or signed agreement. White Light may suspend or limit services for non-payment, unsafe use, unlawful use, security incidents, misuse, or repeated breach of these terms, subject to applicable contract requirements.
We may improve, modify, discontinue, or replace features to maintain security, comply with law, meet vendor changes, improve reliability, or support new IVMS and fleet requirements. Material customer-specific changes will be handled according to the applicable agreement.
10. Intellectual Property
White Light and its licensors retain ownership of software, dashboards, interfaces, documentation, designs, configuration methods, firmware, templates, reports, branding, and other intellectual property supplied with the services. Customers receive a limited, non-transferable right to use the services for their internal fleet operations during the active subscription or contract term.
11. Confidentiality and Privacy
Each party must protect confidential information received from the other party. Personal data, telemetry, and account information are handled according to the White Light Privacy Policy, the applicable customer agreement, and applicable Oman data-protection requirements, including the Personal Data Protection Law issued by Royal Decree 6/2022 and its Executive Regulation issued by Ministerial Decision 34/2024.
12. Warranties and Limitations
White Light will provide the services using reasonable skill and care. Except as expressly stated in a signed agreement, the services are provided without guarantees that they will be uninterrupted, error-free, compatible with every vehicle, available in every location, or sufficient by themselves to prevent accidents, violations, theft, misuse, or non-compliance.
To the maximum extent permitted by applicable law and contract, White Light is not liable for indirect, incidental, consequential, punitive, or special damages, loss of profit, loss of business, loss of goodwill, or losses caused by customer misuse, unauthorized access, network failure, device tampering, incorrect configuration, or third-party systems.
13. Termination
Access may end when the customer contract, subscription, trial, or support arrangement ends. On termination, customers must stop using the services, return or pay for hardware where required, settle outstanding amounts, and preserve or export required reports within the available retention period. White Light may delete, archive, or restrict data according to the Privacy Policy, contract, and retention requirements.
14. Governing Law and Disputes
Unless a signed agreement states otherwise, these terms are governed by the laws of the Sultanate of Oman. The parties will first attempt to resolve disputes through good-faith commercial discussions. If unresolved, disputes will be handled through the courts or dispute-resolution forum specified in the applicable agreement, or otherwise through the competent courts in Oman.
